1. Agreement to Terms

By accessing or using CallBird AI ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

CallBird AI ("we," "us," or "our"), operated by Rocket Solutions LLC, provides AI-powered voice receptionist services for businesses. These Terms govern your use of our website at callbirdai.com and our Service.

2. Description of Service

CallBird AI provides automated voice receptionist services that:

  • Answer incoming phone calls using AI technology
  • Take messages and collect caller information
  • Schedule appointments and provide business information
  • Send SMS notifications for missed calls and messages
  • Provide call transcripts and analytics

3. Account Registration

3.1 Account Creation

To use our Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental/guardian consent
  • Represent a legitimate business entity

3.2 Account Responsibility

You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your password
  • Notifying us immediately of any unauthorized access
  • Ensuring your use complies with all applicable laws

4. Trial Period and Subscription

4.1 Free Trial

  • New users may receive a 7-day free trial period as specified during signup
  • Trial includes limited call minutes and features
  • No payment method required for trial activation
  • We reserve the right to modify or discontinue trial offers

4.2 Paid Subscription

  • Starter Plan: $49/month
  • Professional Plan: $99/month
  • Enterprise Plan: $197/month
  • Billing occurs monthly on your subscription anniversary date
  • Prices are subject to change with 30 days' notice
  • Payment processed via Stripe payment processor

4.3 Automatic Renewal

Your subscription automatically renews unless cancelled before the renewal date. You authorize us to charge your payment method for renewal fees.

5. Cancellation and Refunds

5.1 Cancellation

  • You may cancel your subscription at any time through your account dashboard
  • Cancellation takes effect at the end of your current billing period
  • You retain access to the Service until the end of the paid period
  • No refunds for partial months

5.2 Refund Policy

We offer a 30-day money-back guarantee. After 30 days, we do not provide refunds for any partial subscription periods. Refunds may be considered on a case-by-case basis for technical issues preventing Service use.

5.3 Our Right to Suspend or Terminate

We may suspend or terminate your account for violation of these Terms, fraudulent or illegal activity, non-payment of fees, if required by law, or at our discretion with or without cause.

6. Acceptable Use

6.1 Permitted Use

You agree to use the Service only for legitimate business purposes, answering calls to your business, collecting information from willing callers, and providing customer service.

6.2 Prohibited Use

You may not use the Service to:

  • Violate any laws or regulations
  • Harass, abuse, or harm others
  • Transmit malicious code or interfere with the Service
  • Impersonate another person or entity
  • Collect personal information without consent
  • Make unsolicited calls (spam/telemarketing)
  • Engage in fraudulent activities
  • Violate telephone consumer protection laws (TCPA, DNC regulations)

7. Call Recording and Data

7.1 Call Recording Consent

By using our Service:

  • You acknowledge that calls may be recorded
  • You are responsible for compliance with call recording laws in your jurisdiction
  • You must inform callers about recording where required by law
  • You agree to use call recordings in compliance with all applicable laws

7.2 Data Ownership

You retain ownership of your business data, call content, and customer information. We retain ownership of the Service, AI technology, and platform. You grant us license to process your data to provide the Service.

8. Intellectual Property

The Service, including software, code, algorithms, design, interface, features, trademarks, logos, and branding, are owned by Rocket Solutions LLC and protected by intellectual property laws.

You retain all rights to your business information, customer data collected through the Service, call recordings and transcripts, and your company branding and content.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service during your subscription period.

9. Third-Party Services

Our Service integrates with third-party providers including but not limited to VAPI (voice AI technology), Stripe (payment processing), SMS delivery services, and database and hosting providers.

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service performance or policies.

10. Service Availability

10.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted Service. We are not liable for temporary service interruptions, scheduled maintenance downtime, third-party service failures, or internet or network outages.

10.2 Changes to Service

We reserve the right to modify or discontinue features, update the Service with or without notice, and change pricing with 30 days' notice to existing subscribers.

11. Limitation of Liability

11.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKET SOLUTIONS LLC AND CALLBIRD AI SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Lost profits, revenue, or business opportunities
  • Data loss or corruption
  • Damages exceeding the amount paid by you in the 12 months preceding the claim

11.3 Essential Services Disclaimer

Our Service is not intended for emergency or critical communications. Do not rely on our Service for emergency services (911), life-or-death situations, critical business functions requiring 100% uptime, or legally required communications.

12. Indemnification

You agree to indemnify and hold harmless Rocket Solutions LLC, CallBird AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your violation of any laws or third-party rights, content you provide through the Service, or your failure to comply with call recording or telecommunications laws.

13. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

14. Compliance with Laws

14.1 Telecommunications Regulations

You are responsible for compliance with all applicable telecommunications laws, including the Telephone Consumer Protection Act (TCPA), Do Not Call regulations, state and local call recording laws, and consent requirements for recorded calls.

14.2 General Compliance

You must comply with all applicable laws regarding data protection and privacy, business practices, customer communications, and recording and storing conversations.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of Georgia, Hall County, and the United States, without regard to conflict of law principles.

15.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except you may bring claims in small claims court or we may seek injunctive relief in court for intellectual property violations.

15.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

16. Miscellaneous

These Terms constitute the entire agreement between you and CallBird AI regarding the Service. If any provision is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right or provision is not a waiver of such right or provision.

You may not assign or transfer these Terms. We may assign our rights to any affiliate or successor.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email to your registered address, notice on our website, or in-app notification.

Continued use of the Service after changes constitutes acceptance of modified Terms.
